在注册成功后,您可凭借注册的会员账户和密码登录MYC官方网站并享受我们的服务。注册时提供的资料发生任何变动,您应及时更新。因会员提供的资料或信息不真实、不准确、不完整或无效而产生的法律后果和责任由会员自行承担。如有证据证明您存在不当注册或不当使用多个会员账户的情形,我们可采取冻结或关闭会员账户、取消订单、拒绝提供服务等措施,如给MYC及相关方造成损失的,您还应承担赔偿责任。

 

您应妥善保管会员账户和密码。您理解,MYC无法核实是否是本人使用该账户和密码,因此您应对通过该账户和密码实施的行为负责。如您发现任何非授权使用账户的行为,应立即通知我们。您理解,MYC需要合理时间对您的请求采取行动。对于您未能维持账户安全而在您账户下发生的所有行为,MYC不能也不会对因此产生的任何损失或损害承担责任。

 

2.2在互联网上通过网站所下的订单

 

在网站上所下的订单应当符合第二条规定。

 

2.2.1 用户的产品选择

 

在网站上,用户选择、输入以及确认其有意订购的产品的品类和数量;前述产品被加入用户的“购物袋”。

 

用户可以自行修改其“购物袋”,用户可以通过点击“购物袋”内相应的部分而删除之前所选择的产品、修改订购数量,或添加其他产品。

 

2.2.2 订单的确认

 

用户必须确认配送方式并填写为准确派发订单所必需的信息(配送地址)。

 

一旦信息被适当填写并确认,产品的价格(见以下第五条定义)以及任何配送费用(如有)将会自动显示。

 

用户必须在确认订单前核实其选择的准确性。MYC会以标准的完整性和合理性检查的形式向用户提供技术措施(以检查是否所有必填项目均已填写,所输入的信息在必填项目中是否为恰当的),以帮助用户识别其可能存在的输入错误。用户的订单资料随后会被归纳以进行最后的检查。

 

2.2.3 MYC确认订单

 

收到订单的确认通过短信或邮件发给用户

 

收到订单的确认中应包括订单号和订单状态。

 

消费者可以通过MYC官方网站订购产品(下称“下订单”):全款在线支付的订单自支付完成时成立并生效。

 

其他类型的用户(例如企业、组织或非消费自用的个人等),当MYC以短消息/电子邮件/或其他书面方式通知用户订购的产品成功发货时,该订单成立并生效。

 

订单生效前,您有权修改输入错误。在您提交订单时,请您务必仔细确认所购产品的名称、价格、数量、型号、规格、尺寸、联系地址、电话、收货人等信息。如属刻字服务,您需进一步确认刻字信息。

 

订单生效前,我们可以拒绝接受或取消您已提交的订单。

 

一旦订单生效,用户无法自行修改或取消该订单。

用户购买个性化定制产品(包括但不限于刻字、字母刺绣或其他定制产品)的,订单生效后不得修改或取消。

在所订购产品发货至用户指定的配送地址时,MYC会向用户发出短信或邮件通知用户产品已经发出。

 

2.3订单的证明

 

MYC依法对MYC与其用户之间的所有交易的证据进行存档。如果MYC与其用户对在MYC官方网站中进行的交易发生争议,MYC存档的数据应被作为交易细节的证据。

 

通常,特别是关于订单的性质和日期,MYC和用户明确同意双方之间的电子邮件和短信 ,以及由客户关怀服务中心使用的或网站上的自动记录系统是可以采信的。

 

第三条 产品供应

 

在下订单前,在网站的信息页面上会描述产品的以下信息以告知用户:

 

-产品是否有货;

 

-若产品暂时缺货

 

MYC保留在任何时候不通过通知而更改网站上所供应产品的权利。这不会影响现有的产品订单。

 

第四条 拒绝订单

 

MYC有权拒绝某一超过授权产品数量的订单,即:

MYC还有权拒绝以下订单:(i)对之前的订单中的付款或发货尚存争议的用户所下订单;或(ii)不符合本条款的订单。

 

如果MYC发现订单不符合本条款之规定,将直接通过电话或邮件或短信通知用户。如果用户在收到上述通知后的3日内未能更正其向MYC所下订单中所包含的错误或者与本条款不相符合之处,MYC保留完全取消订单和付款的权利。

 

在下列情况下,MYC有权取消您的订单,并无须承担任何责任或提供任何补偿;若您已付款的,我们会通过原付款方式向您退回您已支付的相关货款:

 

1. MYC认为您违反了本条款、法律法规规定或者存在欺诈等违背公平和诚实信用原则的情形,

 

2. MYC和您协商一致取消的;

 

3. 您提供的配送地址或信息不全或明显错误的(在您已经预留正确联系方式的前提下,我们将会主动尝试联系您补全或更正配送地址及信息或取消订单,若我们无法与您取得联系,我们有权先行取消订单);

 

4. 其他本条款规定的MYC可取消订单的情况,以及法律法规允许取消订单的情形。

 

第五条 产品的价格

 

MYC产品的价格以美金计价和结算,包括税金。MYC保留日后因自身运营政策调整而收取运费的权利。除非您可以直接成功提交订单并完成全部支付,否则相关价格信息仅供参考,不应当视为任何法律意义上的要约或承诺。

 

MYC保留对MYC官方网站中所供应产品的价格进行修改的权利,而无须事先通知您。您将被收取MYC官方网站在订单成立之时所标示的价格,前提是产品在该时间有货。

 

您在MYC官方网站中所下的任何订单,您下订单后应当在我们要求的时限内进行支付(全部货款或预付款)。我们仅接受以所提供的支付方式在线进行的付款(包括银行转账)。

 

所有订单均应以美金支付。请注意,您的订单必须包括发货单。

 

第六条支付条款

 

如果您在MYC官方网站订购产品,提供的支付方式包括微信支付、支付宝支付和网银支付。

 

 

第七条 配送

 

订单将在订单生效后由MYC通过第三方快递进行分派发送。

 

订购产品将仅被配送至下单范围内的国家地址。订购产品将被运送至在订购程序中确定的送货地址。用户仅可以为每份订单提供一个地址。

 

如果在订单中选择的配送地址位于配送区域之外,将无法成功下单。

 

您还可以选择将产品配送至配送区域内的其他个人,例如,当订单为一份礼物时。

 

除非订单中另有约定,,通常的发货时间为5-7个工作日,刻字订单以及批量订单发货时间为60-180个工作日;

 

所有发货时间均自用户完成付款之日起算。

 

如遇节假日订单高峰期,或仓库年终盘点等特殊情况,发货日期可能额外延迟,具体应以MYC官方网站届时公示的最新发货时间为准。

 

产品将以多个或单个包裹运输,包括(如适用)产品、包装、发货单、感谢卡、留言卡(如有)及赠品(如有)。

 

如果因MYC不可控制的事件而导致产品配送延迟的,则MYC应当尽快联系用户,采取措施以尽量减少延迟的影响。如果MYC采取了前述措施,则不应对该事件造成的延迟负责。

第八条 风险转移

 

用户订购的产品将由MYC负责,直至配送至用户指定的收货地址。用户接受并承担在产品配送至配送地址后的所有风险(包括任何产品的损失、被盗或损坏)。用户在签收时应打开快递,确认产品符合购买要求,如有问题应当面拒收。

 

第九条 产品所有权

 

MYC保留产品所有权,直至MYC完全收到款项。

 

第十条 用户改变想法和取消订购的权利

 

用户可以在收货之日起(7)个日历日内将MYC官方网站购买的非刻字定制的产品按如下流程退还至我们的关怀服务中心部并要求退款。

 

所有退货必须包括原始销售收据、并以原始包装退货。请注意,所有退货和换货在被接受前均需要经过质量保证检验。有磨损、损坏或变更的任何产品不能被接受。

 

10.1产品退换货流程:

 

若用户改变想法,想要取消订购,为通知MYC,用户必须:

 

-先拨打客户关怀热线或通过在线聊天联系客服进行退换货申请。所有未开封的商品如需退换请于签收日起7日内申请办理;如因商品质量问题需要退换货,用户应联系客户关怀服务中心并在线提供需退换产品的图片,客服确认后请于三日内寄回退换商品。

 

-如用户需整单退换,用户务必将当次订单中所有商品(包括免费赠品、包装礼盒)全部退回。

 

-如非产品质量问题,由用户承担商品退换的邮资。

 

-如用户在使用了于MYC官方网站购买的产品后出现过敏症状,用户应当联系客户服务中心进行处理。

 

-退换货申请确认后,用户应当将所有需退回的商品退回指定地址

 

退货时需填写退货申请表并写明相应订单号

 

-若我们收到退换货商品与约定退换货订单不符,有权直接拒收此单。

MYC保证,通过MYC官方网站购买的所有产品均为真品。

 

第十二条 适用法律

 

MYC官方网站中进行的所有交易均受中华人民共和国(仅为此之目的,包括香港特别行政区、澳门特别行政区、台湾地区)法律管辖。本条款(或其中提及的其他条款、规则和政策)引起的或与本条款(或其中提及的其他条款、规则和政策)有关的任何争议或纠纷,应首先通过友好协商的方式解决。若协商不成的,该等争议或纠纷应提交至广州番禺区人民法院管辖。

 

第十三条 免责和责任限制 除非法律另有规定,在任何情况下,MYC均不应对因使用MYC官方网站而产生的或与之相关的任何损失承担责任。

第十五条 补偿

 

对于因用户使用MYC官方网站、用户通过MYC官方网站放置或传输的任何内容、信息、软件或其他材料、或用户违反法律或本条款,而以任何方式产生的任何和所有索赔、责任、成本和费用(包括合理的律师费),用户同意补偿MYC、使其不受损害并为其抗辩(但因MYC重大过失或故意不当行为引起的前述情形除外)。MYC保留对将由用户补偿的任何事项完全自行进行抗辩和控制的权利(自担费用);在此情形下,用户同意就对该等索赔的抗辩与MYC进行合作。

 

第十六条 禁止内容

 

用户不得:(i) 进行引擎蜘蛛抓取,“屏幕抓取”,“数据库抓取”,采集电子邮件地址、无线地址或其他联络信息或个人信息,或以任何其他自动方式访问、登入或注册于MYC官方网站、或在MYC官方网站中或通过MYC官方网站提供的任何服务或功能,或者获得用户清单,或者获得或访问MYC官方网站中的、或来自于MYC官方网站的其他信息或功能、或通过MYC官方网站获得或访问其他信息或功能、或者获得或访问在MYC官方网站中或通过MYC官方网站提供的任何服务中的、或来自于该等服务的任何其他信息或功能、或通过该等服务而获得或访问其他信息或功能,包括但不限于,与MYC官方网站或在MYC官方网站中或通过MYC官方网站提供的任何服务相连接的任何服务器或数据库中的任何信息;(ii) 通过任何方式获得或试图获得,对计算机系统、材料、信息或在MYC官方网站中或通过MYC官方网站可以获得的任何服务的未经授权的访问;(iii) 以中断、损害MYC官方网站或服务,或使得MYC官方网站或服务发生瘫痪、超负荷,或对MYC官方网站或服务进行破坏为目的,而使用MYC官方网站或在MYC官方网站中或通过MYC官方网站可以获得的服务,或者干扰任何其他方对MYC官方网站的使用和享用,包括但不限于,发出大量不是根据要求而发出的信息或大量请求;(iv) 违反MYC或任何第三方的知识产权或其他专有或合法权利而使用MYC官方网站或MYC官方网站的服务或功能;或者(v) 违反任何适用法律而使用MYC官方网站或MYC官方网站的服务。用户进一步同意,用户不会试图(或鼓励或支持其他人试图)采用技术手段规避或者绕开、进行反向工程、破译,或另行更改或干扰MYC官方网站及内容,或未经授权使用MYC官方网站及内容。用户不得通过任何方式获得或试图获得任何材料或信息,如该等材料或信息并非是有意向公众提供或通过MYC官方网站予以提供的材料或信息。

第十八条 变更与终止

 

我们可根据国家法律法规变化及维护交易秩序、保护消费者权益需要,不时修改本条款、本条款的补充协议(下称“变更事项”)并公示。如用户对已生效的变更事项不同意的,用户应当于变更事项确定的生效之日起停止使用MYC官方网站,变更事项对用户不产生效力;如用户在变更事项生效后仍继续使用MYC官方网站的,则视为用户同意已生效的变更事项。

 

我们可以根据经营情况决定维持或自主关闭有关MYC官方网站。若网站对用户关闭的,我们将依法提前三十日在网站显著位置公示有关信息。

 

如果我们认为用户违反了我们的《MYC官方网站销售通用条款和条件》、《个人信息处理规则》或者适用法律,或者用户盗用他人账户、扰乱市场秩序、采取不正当手段谋利、实施危害MYC官方网站安全或侵犯MYC官方网站合法权益等行为的,我们可以不作通知而直接限制、中止或终止其访问MYC官方网站和/或其服务,且不承担责任。

 

本条款终止后,对于您在本条款存续期间产生的交易订单合法有效的,我们将继续履行。

 

本条款终止后,我们可能会根据适用的法律,依法保留相关记录,但不承诺按照令用户满意的方式保存、留档用户在本网站提交、保存的任何个人数据或内容。

 

第十九条 弃权

 

我们未能行使或执行本条款的任何权利或条款,将不构成对该等权利或条款的放弃。如果本条款的任何条款被有管辖权的法院确定为无效,用户和MYC均同意,应努力使得双方的意图最大程度的有效(如在该条款中显示的一样),并且本条款的其他条款应继续保持完全生效和有效。

 

第二十条 补充协议

 

由于互联网高速发展,您与MYC签署的本条款并不能完整罗列并覆盖用户与MYC所有权利与义务,现有的约定也不能保证完全符合未来发展的需求。因此,任何适用的有效的法律法规,以及MYC官方网站发布的法律声明、产品或服务说明、交易规则等经依法公示的,视为本条款之补充协议。

 

第二十一条 知识产权和商标

 

MYC官方网站中出现的所有商标、标识和服务标志(“商标”)均为注册和/或尚未注册的MYC商标,并且为MYC/或其任何子公司或关联方的专有财产。本条款,以及在本条款和MYC官方网站的外观和印象中出现的、本条款所包括的所有材料、组成部分和内容(包括画图、设计、插图、照片、文字、计算机代码、声带和图解),均为MYC/或其任何子公司或关联方的专有财产。MYC官方网站中所包含的任何内容,均不得被解释为,以暗示或其他方式,授予无须经MYC书面许可即可使用MYC官方网站中所展示的任何商标的任何许可或权利。用户被许可,仅为与在MYC官方网站下订单或购物相关的非商业目的,而以电子方式复制MYC官方网站页面、和以纸质形式打印MYC官方网站页面。除非我们事先给予用户具体的书面许可,对MYC官方网站及其内容和信息的任何其他使用均被严格禁止。

MYC官方网站所有内容的版权均为MYC拥有。所有权利均被保留。
